Terms of use

These terms govern your use of BenaDealer's website, web app and mobile apps (the "Service"). By creating an account or using the Service, you agree to them on behalf of yourself and the dealership you use it for. If you do not agree, do not use the Service.
Accounts
- You must be at least 18 and authorized to act for your dealership.
- Keep your login secure. You are responsible for activity under your account.
- A dealership's Admins control who can access its records and can deactivate team members.
Beta and pricing
The Service is currently offered free of charge as a beta. Features may change, and some may be added, limited or removed. We will give at least 30 days' notice in the app or by email before introducing any paid plan, and you will not be charged unless you choose a paid plan.
Your data and your responsibilities
- You own the records you enter. You give us permission to store and process them only to provide the Service.
- When you enter a buyer's personal information, you confirm you have the right to collect it and use it for the sale, and that you will handle it according to Canadian privacy law.
- Do not upload unlawful content, try to access other dealerships' data, or interfere with the Service.
Paperwork and compliance
BenaDealer helps you prepare documents such as bills of sale, disclosure checklists and all-in pricing. It is a tool, not legal advice. You remain responsible for the accuracy of every document and disclosure, and for meeting the requirements of OMVIC, the Motor Vehicle Dealers Act, 2002, the Consumer Protection Act, 2002 and any other law that applies to you. Review each document before giving it to a customer.
Third-party data
Vehicle specifications decoded from a VIN come from third-party sources and may be incomplete or wrong. Always confirm vehicle details before relying on them.
Availability
We work to keep the Service available and your data safe, but we do not guarantee it will be uninterrupted or error-free. Download copies of important records (for example, bills of sale and Excel exports) and keep your own backups.
Limitation of liability
To the extent the law allows, the Service is provided "as is", and BenaDealer is not liable for indirect, incidental or consequential losses, lost profits, or losses caused by inaccurate information you enter or rely on. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (which, during the free beta, is $0). Nothing in these terms limits rights you have under consumer protection law that cannot be waived.
Ending your use
You can stop using the Service and delete your account at any time (see the privacy policy). We may suspend accounts that break these terms or put the Service or other users at risk.
Changes
We may update these terms. We will post changes here and, for significant changes, notify you in the app or by email. Continuing to use the Service means you accept the updated terms.
Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
